Welcome to Enjoy The Drive ("ETD", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our vehicle rental marketplace platform, including our website, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

Enjoy The Drive operates a peer-to-peer vehicle rental marketplace that connects vehicle owners ("Hosts") with individuals seeking to rent vehicles ("Guests"). ETD facilitates transactions between Hosts and Guests but does not own, operate, or control the vehicles listed on the Platform.

You must create an account to use certain features of the Platform. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for all activity that occurs under your account.

Each booking creates a binding rental agreement between the Host and the Guest. By completing a booking, both parties agree to the specific terms of that rental, including dates, times, pick-up/drop-off locations, pricing, and any additional terms set by the Host.

Guests must inspect the vehicle at pick-up and report any pre-existing damage. Failure to document pre-existing damage may result in the Guest being held responsible for such damage upon return. Hosts are responsible for providing vehicles in safe, operable condition that comply with all applicable laws.

Vehicles rented through the Platform may only be driven by the registered Guest. The following uses are strictly prohibited:

All prices displayed on the Platform are in US Dollars unless otherwise specified. The total rental cost includes the daily rate, applicable taxes, service fees, and any optional extras or add-ons selected during checkout. Prices are subject to change until a booking is confirmed.

Payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you authorize ETD to charge the specified amount at the time of booking confirmation. For split payment plans, subsequent charges will be processed automatically on the scheduled dates.

A security deposit may be held at the time of booking to cover potential damages, fuel charges, or late return fees. The deposit amount varies by vehicle and will be disclosed before confirmation. Deposits are released within 5-10 business days after the vehicle is returned in satisfactory condition.

Hosts who cancel a confirmed booking will receive a cancellation penalty. Guests will receive a full refund. Repeated Host cancellations may result in account suspension or removal from the Platform.

Approved refunds are processed within 3-5 business days. The refund will appear on your original payment method within 5-10 business days depending on your financial institution.

Hosts are responsible for maintaining valid auto insurance on their listed vehicles. Guests are encouraged to verify their personal auto insurance coverage or purchase additional coverage through the Platform if offered. ETD does not provide primary insurance coverage for rentals.

Guests are liable for any damage to the vehicle during the rental period, including but not limited to collision damage, theft, vandalism, and interior damage. Guests are also responsible for any traffic violations, parking tickets, or tolls incurred during the rental period.

To the maximum extent permitted by law, ETD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. ETD's total liability shall not exceed the amount of fees paid by you to ETD in the twelve months preceding the claim.

In the event of a dispute between a Host and Guest, both parties agree to first attempt to resolve the matter through ETD's internal dispute resolution process. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

ETD strives to provide a reliable and secure marketplace. We are responsible for maintaining the Platform's functionality, processing payments, and facilitating communication between Hosts and Guests. However, ETD does not guarantee the availability, condition, or quality of any vehicle listed on the Platform. ETD is not a party to the rental agreement between Hosts and Guests.

All content on the Platform, including text, graphics, logos, and software, is the property of ETD or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without prior written consent.

ETD reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any behavior that threatens the safety or integrity of the Platform. Upon termination, your right to access the Platform ceases immediately. Any pending bookings may be cancelled, and applicable refunds will be processed per our cancellation policy.

ETD reserves the right to modify these Terms at any time. We will notify registered users of material changes via email or Platform notification. Continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
